Former Texas prosecutor disbarred for sending innocent man to death row

From the article:

"A study this month said that U.S. exonerations hit a record high in 2015 as more prosecutors have been looking at troubled cases."

Now if we could only exploit this trend to have the right people look at another troubled case.

Have avoided seeing the series because I know I'll get angry and depressed from all reports. Did see a great recent doco doing the rounds called The Fear of 13. A guy wrongly convicted of murder and on death row for 20 years. His story is so unbelievably true that its rivetting. Its just him in front of a camera with minimal dramatizations but the guy is a born story teller so its never boring. It is one of the best doc films I've seen and I've seen thousands. Do yourselves a favour as Molly would say.

Thanks for the heads up. I see he is another Innocence Project case and another victim of the Reid Technique. And more reinforcement that we need to cast Oswald's "conviction" in the same light.

Most of these cases have been overturned by the advent of DNA testing. This guy's was but the legal hurdles he had to contend with was an abomination of judicial red tape and appeals system. With Oswald its a different story IMO. We need the 4K Darnell image. The Reid technique won't quite be enough in my view despite evidence of it's use. We can argue its flawed and unjust but unless we have undeniable physical evidence Oswald could not have been shooter we don't have anything. This guy gave up and instructed the governor to proceed with his execution by dropping his appeal. It was only when the governor intervened and ordered the DNA investigation to be fast tracked that things started to go his way when a fortuitous piece of evidence came to light. I don't believe in miracles but this case came close to convincing me otherwise. The Darnell image is Oswald's miracle but not while it remains fuzzy. I know some here don't believe I should use that F word but it is what it is at the moment despite the solid supporting evidence we also have. My personal feeling after watching this film is that simply being innocent is sometimes simply not enough. The law is designed to protect the law first and foremost. PM is Oswald but so what? This isn't a resignation on my part, far from it, but the law is a law unto itself.

As much as I hate to say it Paul, I think you're right. We need undeniable proof that Oswald was standing on the front steps of the TSBD to get this case reopened.

Thanks Paul. It is true that most Innocence Project cases (337) have obtained exonerations by DNA tests. There have been 7 exonerations via other evidence. There is evidence that could be DNA tested in this case (hair, fibers etc). The problem is they will only take cases where the accused has been tried. convicted and sentenced. The dead only have one right - that is to RIP.

We do need the Darnell frame. The Reid Technique being used in and of itself is immaterial in any case - unless there are issues over the bona fides of evidence or statements - particularly confessions. The former is certainly true with Oswald. But proof regarding his alibi (an original stll frame from Darnell) and the means by which they eliminated his alibi and built an entire fake case against him, should not be kept as separate issues. For me, this has become bigger than Oswald. It is about his exoneration, but it is now also about helping rid the Justice System of this cancer.

I actually started work this morning on an open letter to the people of America. I am going to try and distribute it as widely as I can.

Don't worry about the "fuzzy" word... it's a technical, borderline semantical issue aimed at deniers who use the "f" word in the context of never being able to tell who it is. Or even the godamn sex. This frame is in focus... it's the multi-generational issue that makes it lack sufficient definition.

I hate to say and admit to it too, Hasan. It actually makes me sick to the core. LNs and naysayers know this too so they pretty much say what they want. As Greg points out they even have the gall to suggest PM is a woman. I first laughed at them but now when I see what that prick Doyle is still doing over at Stinky's and is still allowed to do by that POS I get upset bro. It breaks my heart. Oswald was on the steps of the TSBD during the shooting but hardly anyone gives a shit because they need 200% proof. An alibi and an image that definitely appears as Oswald is not good enough. Those intellectually dishonest pricks can all go and get fucked. Sorry Greg but its been awhile.

I do worry about the word 'fuzzy' Greg cause the last thing I want to risk is to seem to demean all the fantastic work Stan and Barto have done with regards to PM. As well as others. I definitely don't mean to and I hope I don't come across that way. Those guys are the real JFK research heroes. I am just a mug punter.

You give a shit. That is a burdon on anyone. Much easier to just accept or ignore whatever is dished up. But it means you never take the easy road. You say what you believe and it keeps everyone else honest.
